Book-A-Pro Terms of Service

These Terms of Service (“Terms”) govern the delivery of live lead transfers by Estatehub LLC (“Provider”) to the recipient company (“Client”) as part of the Book-A-Pro pay-per-transfer program.

1. Lead Definition and Delivery

  • A "lead" is defined as a live phone transfer to the Client, wherein the lead verbally agrees to speak with the Client about a relevant service request.

  • The Provider pre-qualifies leads before attempting transfer. Once a lead is accepted over the phone, it is considered delivered and billable.

  • The Client may also receive the lead’s submitted information via text or email for reference.

2. Transfer Attempts and Availability

  • Leads are transferred on a first-come, first-served basis.

  • If the intended Client is unavailable, the lead may be offered to another qualified Client in the area.

  • Leads may be reattempted later if no Client answers initially.

3. Exclusivity

  • Leads are exclusive and not shared with multiple Clients.

  • If a lead resubmits a request at a later date (minimum 30 days), the Provider reserves the right to reassign it to a different Client if applicable.

4. Lead Limits

  • Clients may set a weekly lead cap.

  • Once a cap is reached, leads are offered to others unless no alternative exists. In such cases, capped Clients may still be contacted with the option to accept or decline.

5. Billing and Payment

  • Clients are charged immediately upon accepting a live transfer.

  • All billing is managed through card-on-file authorization. Failed payments result in a pause on lead delivery until the issue is resolved.

  • No refunds will be issued for accepted leads. Exception cases (e.g., accidental duplicate transfers or prior bookings) may be credited solely at the discretion of the Provider.

  • The Client is responsible for ensuring their payment method is current and valid prior to accepting additional leads.

6. Disputes

  • Disputes must be submitted in writing within 7 calendar days of the transfer.

  • All dispute decisions are final and at the discretion of the Provider.

7. Client Conduct and Legal Compliance

  • The Provider adheres to TCPA and CAN-SPAM regulations when acquiring and transferring leads.

  • Once a lead is transferred, the Client assumes full legal responsibility for any and all further contact with that lead.

  • The Client agrees to maintain compliance with all applicable local, state, and federal regulations — including but not limited to the Telephone Consumer Protection Act (TCPA), CAN-SPAM Act, and Do Not Call (DNC) rules.

  • Estatehub LLC is not liable for any violations committed by the Client in their outreach, marketing, or business practices following lead transfer.

8. Termination and Pausing

  • Either party may terminate or pause this agreement at any time without advance notice.

  • Any unpaid balances become immediately due upon termination.

9. Governing Law

  • This agreement is governed by the laws of the State of North Carolina, without regard to conflict of law principles.

10. Dispute Resolution

  • Both parties agree to make reasonable efforts to resolve any disputes through informal discussion prior to initiating formal legal action.
